Commercial Lease Agreement (CLA)

The Com­mer­cial Lease Agree­ment (CLA) enables com­mer­cial busi­ness­es to lease the LiveO2 Sys­tem through an afford­able, flex­i­ble, and ful­ly sup­port­ed leas­ing pro­gram. Under this agree­ment, the LiveO2 Sys­tem is deliv­ered and billed month­ly, includ­ing com­pre­hen­sive main­te­nance and equip­ment cov­er­age through our Com­mer­cial Ser­vices Agree­ment.

Eligibility and Intended Use

  • Com­mer­cial Busi­ness­es Only: Suit­able for fit­ness cen­ters, clin­ics, per­for­mance facil­i­ties, well­ness cen­ters, and relat­ed businesses.
  • Prop­er Use Required: Equip­ment must be used strict­ly as intend­ed. Unau­tho­rized mod­i­fi­ca­tions or removal from approved premis­es are pro­hib­it­ed with­out writ­ten permission.

Lease Terms

  • Ini­tial Lease Peri­od: 180 days
  • Auto­mat­ic Renew­al: Con­tin­ues month-to-month after the ini­tial term.
  • Ear­ly Ter­mi­na­tion: No refunds if ter­mi­nat­ed before the min­i­mum lease peri­od ends.

Payment Structure

  • Ini­tial Pay­ments: First and last month’s pay­ments due upfront before sys­tem delivery.
  • Recur­ring Billing: Month­ly auto­mat­ed billing begins in the third month via cred­it card, deb­it card, or PayPal.
  • Pay­ment Adjust­ments: Pay­ments may peri­od­i­cal­ly adjust to reflect infla­tion or cur­ren­cy changes, based on offi­cial index­es (such as the Con­sumer Price Index), with a 60-day advance notice.

Operator Training and Certification

  • Cer­ti­fied Coach Require­ment: LiveO2 ses­sions must be con­duct­ed by a Cer­ti­fied LiveO2 Coach.
  • Vir­tu­al Train­ing Option: If a Cer­ti­fied Coach isn’t avail­able, vir­tu­al train­ing by LiveO2 staff can be pro­vid­ed (fees apply).
  • Com­pli­ance: Adher­ence to LiveO2 stan­dards for oper­a­tion and train­ing is manda­to­ry and con­sti­tutes a mate­r­i­al require­ment of the lease.

Maintenance and Repairs

  • Lessee Respon­si­bil­i­ty: Rou­tine care and imme­di­ate report­ing of any equip­ment issues.
  • LiveO2 Respon­si­bil­i­ty: Prompt replace­ment or repair of equip­ment at no addi­tion­al cost for issues result­ing from nor­mal use.

Damage and Liability

  • Lessee Lia­bil­i­ty: Respon­si­ble for dam­ages due to mis­use, neg­li­gence, fire, flood, theft, or events beyond nor­mal wear and tear.

Lease Termination

  • Ter­mi­na­tion Notice: Either par­ty may ter­mi­nate with at least one week’s writ­ten notice.
  • Return Pol­i­cy: Equip­ment must be returned in good work­ing order upon ter­mi­na­tion; final month’s pay­ment is applied accordingly.

Buyout Option

  • Pur­chase Cred­its: 25% of each month­ly pay­ment accu­mu­lates as cred­it toward an even­tu­al equip­ment purchase.
  • Expi­ra­tion: Cred­its expire and are for­feit­ed if the equip­ment isn’t pur­chased at lease end.
