Commercial Lease Agreement (CLA)

Allows for the lease of LiveO2 sys­tem to com­mer­cial busi­ness only. Under the lease agree­ment the sys­tem will be deployed on a month­ly basis with a recur­ring auto­mat­ed month­ly billing. The sys­tems will be ful­ly cov­ered under the Com­mer­cial Ser­vices Agree­ment as part of the lease price.

Lease Term

The lease agree­ment will have a min­i­mum dura­tion of 30 days and will renew on a month­ly basis. No refunds will be pro­vid­ed for ear­ly ter­mi­na­tion of the lease.

Deposit

 To enter into the lease agree­ment, a secu­ri­ty deposit or an approved cred­it check will be required.

Payment

 The month­ly lease pay­ments will be on a recur­ring auto­mat­ic billing via cred­it card, deb­it card, or PayPal.

Equipment Use

 The Lessee must use the equip­ment for its intend­ed pur­pose and must not mis­ap­ply, dam­age, or mod­i­fy it in any way. The Lessee is not allowed to remove the equip­ment from the des­ig­nat­ed premis­es with­out LiveO2’s writ­ten approval. 

Maintenance

 The Lessee is respon­si­ble for keep­ing the equip­ment in good con­di­tion and must cov­er any repairs or replace­ments need­ed due to mis­use or abuse.

Repair

In the event of a fail­ure due to nor­mal use, LiveO2 will imme­di­ate­ly replace the dam­aged or bro­ken equip­ment at no cost to the Lessee under the term of the Com­mer­cial Ser­vices Agree­ment. The Lessee’s billing will also be sus­pend­ed until the replace­ment equip­ment or com­po­nents are delivered.

Damage

The Lessee is ful­ly respon­si­ble for all dam­ages to the equip­ment beyond nor­mal wear and tear, includ­ing but not lim­it­ed to fire, flood, and theft.

Termination

Either par­ty may end the agree­ment at any time. Upon ter­mi­na­tion, the Lessee must return the equip­ment to LiveO2 in good con­di­tion. The Lessee must con­tact their sales rep­re­sen­ta­tive at least one week pri­or to end­ing the lease to arrange the return ship­ping and to stop auto­mat­ic billing.

Buyout

A por­tion of each month­ly pay­ment will be applied as cred­it if the Lessee choos­es to pur­chase the sys­tem at the end of the lease. If the Lessee does not pur­chase the sys­tem, the cred­it will be forfeited.
